These Terms of Service ("Terms") govern your access to and use of the Civaptic website and platform (collectively, the "Service") operated by Civaptic Inc. ("Civaptic", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service in any way that violates applicable federal, provincial, or local law or regulation.

Accounts

Municipal clients are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. You agree to notify us immediately of any unauthorized use of your account.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Civaptic Inc. and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Civaptic.

Municipal Data

You retain all rights to the data you input into the Civaptic platform. We do not claim ownership of your data. We process your data only as described in our Privacy Policy and any applicable Data Processing Agreement.

Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

To the maximum extent permitted by applicable law, Civaptic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the date at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
